To implement the legislative intent of ESSHB 2418 Section 8 www.leg.wa.gov/pub/billinfo/2005-06/Pdf/Bills/House%20Passed%20Legislature/2418-S2.PL.pdf , Safe Harbors and the Washington State Department of Community, Trade, and Economic Development will make the following changes to the state's homeless management information system (HMIS) program policies, effective June 7, 2006.

Personally identifying information about homeless individuals for the Washington homeless client management system may only be collected after having obtained informed written consent from the homeless individual to whom the information relates.

Background

The Informed Consent Process: Informed consent is an educational and informative process that requires specific elements of information.  In addition, an informed consent document, requiring the signature of the client, documents the informed consent process.  The signed document must be filed with the balance of the paper documentation at the agency and retained for 7 years.

 

Types of Informed Consent Documentation:  Safe Harbors requires written information consent:

 

    Parental/Guardian Informed Consent Document – this same document should be used in obtaining informed consent from a parent or guardian of a child or an adult individual who cannot legally give consent for participation in Safe Harbors. The guardian must be a court appointed legal guardian or durable power of attorney for healthcare.  There needs to be one Informed Consent form for each individual in a household provided service.  *NOTE: This informed consent MUST be obtained prior to entering data into the Safe Harbors application 

 

 

Non-English Speaking Clients

The informed consent process must be presented in a language that is understandable to the clients.  For those individuals that do not speak English, it is important to have a translated informed consent document available. If the individual obtaining informed consent cannot communicate with the client, an interpreter must be available during the informed consent process to explain the Informed Consent process and initial the signed form.

 

Instructions

 

  1. Copy English language form here - Informed Consent and customize it with your agency/program name.  Have the Spanish translated form customized and available as well.
  2. At Intake, present Informed Consent Form and discuss with client.  Stress importance of collecting as much information as possible.
  3. Have client initial the options, choose one by printing their name on the line with their choice and signing the form.  If you are serving a household, the ‘head of household’ should sign a form for anyone not able to sign for themselves (see Parent/Guardian Informed Consent).
  4. Record information into your Safe Harbors program, per client’s instructions.
  5. File the form with other client paperwork and retain for 7 years.
